However, our mediation services provide the most diplomatic and peaceful approach towards finding a resolution. We offer a variety of different services to suit our client’s needs. Mediation

Mediation is a non-adversarial method of alternative dispute resolution (ADR) in which a netural third part helps resolve a dispute. The mediator does not have the power to render a decision on the matter or order an outcome but may be able to propose creative solutions or accomdodations. If a satisfactory resolution cannot be reached, the parties can pursue arbitration or a lawsuit. It is private and confidential, as opposed to trials, which are very public. The process is less expensive than a prolonged and costly trial. Both parties typically share in the cost of a mediator.

Arbitration Alternative

In the event mediation does not resolve the real estate dispute, arbitration is an alternative means of settling a dispute by impartial persons without proceeding to a court trial. It is sometimes preferred as a means of settling a matter in order to avoid the expense, delay, and acrimony of litigation. There is no discovery and there are simplified rules of evidence in arbitration.

The arbitrator or arbitrators are selected directly by the parties or are chosen in accordance with the terms of a contract in which the parties have agreed to use a court-ordered arbitrator or an arbitrator privately selected. Arbitrators typically are either an attorney or have at least seven years of experience in the particular area of law or a retired Supreme Court judge. If arbitration is a consideration, NJREM has the ability to offer you this service utilizing New Jersey Certified Arbitrators or can assist you in securing a third-party arbitrator to meet your requirements.

If there is no contract, usually each party chooses an arbitrator and the two arbitrators select a third to comprise the panel. When parties submit to arbitration, they agree to be bound by and comply with the arbitrators' decision. The arbitrators' decision is given after an informal proceeding where each side presents evidence and witnesses; hearings usually last only a few hours and the opinions are not public record.
